No, Kabuto is the Jinchuuriki. He took a piece of orochimaru's flesh and obsorbed his power into himself. Oro would have been the biju. Take into note that the legend most of naruto is derived from calls the 8-tailed beast by the name Yamato-Orochi, and it's also who Orochimaru was modeled after.

Yamato-Orochi was the 8-tailed snake that was gutted and the sword Kusanagi-no-Tsurugi was found inside. Orochimaru pulls the sword Kusanagi-no-Tsurugi from his stomach..

You're also mixing things up. Sasuke took into him part of Orochimaru, but itachi destroyed him. And you also said it yourself, Sasuke took on the physical body of Orochimaru, Kabuto took on Orochimaru's demonic chakra. He never actually put any flesh into him, remember that Kabuto burned the flesh when he preformed the procedure to extract Orochimaru's "essence".

Also, we know Oro had parents, it's unlikely for bijuu to have parents. The 3rd knew him very well, so if Oro was a Bijuu, he would had revealed it. And one more thing, if Oro was a Bijuu, he would had used his demonic chakra in the fight against the 3rd.

a tailed beast cant just be replaced like that easily.. and orochimaru can't do that on his own to transfer EVEN IF HE HAD THE 8TH tailed in him, right into kabuto or sasuke..
so IF and i mean really IF orochimaru has the 8th tailed inside him, we can't get him back that easily because itachi's susano has put him into another dimension..
sasuke didn't used that technique, but orochimaru did..because sasuke let him free oro could use it.
so sasuke AND kabuto has NOTHING to do with the 8 tailed even if oro has it which i really doubt..

so to keep it short:

Why would it be unlikely for a biju to have parents? It was Kishi's original design for Naruto to be the child of the dead Kyuubi but then he changed it.

I never said that the tailed beast was replaced, nor did I say he had the 8 tailed beast in him. I said he was a demon, even the third told him he has "become a true demon" in the anime before their fight. Itachi sealed away the physical form of Orochimaru when he escaped from Sasuke, but when Sasuke and Orochimaru first merged and Sasuke took over the body, Kabuto took Oro?s remains and burned them, then put them into a potion which he drank, endowing himself with Orochimaru?s power. My thoery of Orochimaru being a physical form of the 8-tails states that since Kabuto took the potion to take on Orochimaru's chakra/power then he would in fact be a Jinchuuriki.

But Oro's parents have graves in konoha, i think that means that they were Konoha shinobis. Also he needs a body to live in. I don't think a Bijuu needs one. They are pure chakra in beast form.

the strongest villain tends to be the main antagonist. In the manga the strongest villain is either Pain or maadara. Oro couldnt match up with Pain, Maadara or even Itachi, so kabuto taking his powers i think doesnt stand a chance against them.

( Yakushi Kabuto loyalties are at the heart of his character. When he first appeared in the series he played the part of the trusting experienced confidant. Before the first test of his latest Chuunin exams, Kabuto interacts with the Rookie Nine. He somewhat gains the trust of Team 7 and even shows them his information cards about various ninja. When the teams enter the Forest of Death for part 2 of the exams, Kabuto shows up after a near fatal encounter between Team 7 and three Sound ninja. Kabuto shows up just in time to stop Naruto from opening the scroll that they possessed, which would knock their team out disqualifying them from the competition.

Kabuto Kabuto hatches a plan, asking them to head towards the Tower at the center of the forest. He surmised that other teams would be in the vicinity, which would allow Naruto and company to steal the scroll they required. While executing the plan, Kabuto and Team 7 are halted by Rain Ninja, who use Genjutsu to try and tire out in order to pilfer the scrolls from the team. In this sequence, Kabuto?s glasses are knocked off, showing his eyes, which took a deep hue of red bloodshot. This combined with Kabuto?s ?old blood? comments has led many viewers to speculate he may be harboring some secret ability, although none have been revealed to date. Kabuto, like in previous years chose to refrain from entering the combat rounds of the Chuunin exams. Though his teammates entered, Kabuto chose to withdraw much to the surprise of Team 7.
