Why does Tobi always has his sharingan active?

It's because Tobi needs it for his Space/Time Ninjutsu. And he's mastered it to the extent where there is a minimal drain on his Chakra levels. That's why he always has it active.

either hashi dna or its training...let me explain

hashi dna.....the hasi dna could alter he dna enough to make it active all the time like kakashi cant turn it off because he isnt and uchia but this is unlikely just a posibility

training- this is the most likely reason....remember dragon ball z and the time chamber and the way goku trained gohan was to keep super sayin activated 24 hrs a day because it made him use to it and then they came out much stronger then vegeta

same with tobi he keeps it active as a way to be in constant training and stain on his body to become more powerful and madara probably taught him to do this because madara seems to have it on all the time aswell

i think maybe because he had it activated when his body was crushed so it's like permanently activated or something and thanks to the Senju DNA it has minimal drain on his chakara levels
