Both Minato and Hiruzen performed Fuinjutsu, so it's okay to use them as long as they will benefit the village I suppose. I would also assume Tobirama used Edo-Tesei in some instances too, so there's that.

Ninja dont intentionally create forbidden jutsu, they determine that based on the risks or how dangerous it can be.

I think the rasen-shuriken was once deemed forbidden by Tsunade for its lethal risk to the user, until naruto learned how to throw it(Which is the true significance of a shuriken)

if madara was a kage, he would use forbidden jutsus, but it doesnt matter because he's kage level anyways. no need to become a kage if u can reach kage-level

The only instances we've seen a kage using forbidden techniques is under extreme circumstances. Tsunade didn't use Byakugou until she had to enter the battle, Hiruzen and Minato didn't use the RDS unless they absolutely had to, etc.
