Kabuto was also fighting to capture, not to kill. The whole point of him siding with Tobi was to have Sasuke for himself, and he always tried to re-write Itachi's conscious so he can have him under his control again.

The only reason they won is because Itachi just happens to have the one genjutsu that doesn't require any of the 5 senses, while every other genjutsu they had required direct eye contact, which Kabuto countered against
