interesting theory nagato is TOBI. Highly unlikely but itachi did say maadara was weakened , maybe Nagato needed the EMS to control the kyuubi. H e discovered that maadara was still alive, confronts him and defeats him. We know the rinnegan can take over other people bodies. Maybe he used a justu to takeover maadara, gaining his EMS one eye and the rinnegan on the other. As i said its highly unlikely that Tobi is nagato but its an interesting theory

Well if Tobi has the rinengan and controls the bodies, than that conversation in the last manga chapter is kind of pointless. But if Kishis goal is to throw us into confusion, than it may be possible. BUT i don't think he will confuse the story so much.

well the nagato is the original rinnegan user..
so it's kind of impossible for yahiko having them just like that..
it's like kakashi's sharingan, he can't use the full powers of the sharingan like itachi did and like sasuke does..
so even if nagato would've died and yahiko took his eyes.. he never could use the full powers i think.

so the only possibility left is that nagato is still alive, and controlling the pein bodies from somewhere.
