Idk why people think Minato has the kyuubi chakra. Just because he used the DDS doesn't mean it's inside him. If that was the case then Both hokages and orochimaru's arms would still be in Hiruzen. Once Orochimaru cut the Death Demon's stomach, the seals were broken meaning the kyuubi's chakra has been released along with Orochimaru's arms and hokage's souls

In case of madara kabuto already released the jutsu because of which madara who was no more under his control was quick enough to perform the necessary hand seals........he was a summon after all...a summon can break a contract only after the summoning jutsu is released....but in case of tobirama oro didn't give himnfreedom for movement, he didn't release the jutsu yet, he stregthened his controk because of the zetsu body he is using.....
