Yeah i explaind this in the old forum...it was(my theory) becuz Obito did exactly the opposite of what u had to do to get Mangekyou which could possibly give u an even stronger mangekyou sharingan. Instead of killing his best friend he died protecting hi best friend, thus unlocking a new mangekyou sharingan possibly even stronger than a normal one. But then b4 he died the sharingan was transfered to kakashi without him knowing he had the MS but years later he discovered he had it.

Let's throw it into the category of "Will extreme emotions allow someone to activate the MS regardless as to if a real person dies"

Now, this could be a mis-translation, but I highly doubt it as most translations say the exact same thing. Just because we didn't see Obito use the MS in front of us before doesn't mean that he didn't use it when he was crushed by rocks.
